Mercedes gears up for legal battle

Mercedes Benz Europe is locked in a #5m legal battle with Leeds-based Tenhill Computer Systems after a financial software project ended in acrimony.

Tenhill last week issued a High Court writ claiming damages in excess of u2.8m from Mercedes Benz Finance (MBF), after the car maker terminated a software and services contract.

But the move by Tenhill prompted MBF to reveal that it was preparing to sue the software company for up to #5m.

Richard Whitton, commercial director at MBF, said: 'MBF decided to terminate the contract, because in our view Tenhill had failed to perform.

'As a result, MBF estimates its losses to be in the region of between u3m and u5m, which we expect either Tenhill or its insurers to pay.'

The contract between the two companies was signed on 26 June 1996. It involved Tenhill supplying Portfolio, its client-server product, to MBF's western European region. MBF would not explain what circumstances led it to terminate the contract.

Financial software supplier Tenhill declined to comment.
