Some details about the EU directive on Data Protection (Computing, 29 May) require clarification.
The 1995 directive must be implemented into UK law by 24 October 1998.
Manual records held at the time the legislation is passed could have until 2001 or 2007 to comply, assuming legislation is passed in 1998, and depending on the interpretation of the regulations.
Computerised records being processed at that time would have to comply within three years. Computerised, semi-automated and some manual records created after the passing of the legislation will have to comply straightaway.
An individual's right of access to computerised records held on them is enshrined in the Data Protection Act 1984, and will continue. It is not yet clear whether data subject access to manual records will be a right from 1998.
